Terms & Conditions

These Terms & Conditions form a legally binding agreement between you — whether personally or on behalf of an entity ("you") — and Stayza ("Stayza", "we", "us", or "our"), governing your access to and use of the Stayza website and Services.

By accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you must stop using the platform immediately.

These Terms should be read together with our Privacy Policy, Refund Policy, and Cookie Policy, which together govern your use of Stayza.

Stayza is an online accommodation discovery platform that helps students and travellers in Pakistan find verified hostels, shared apartments, rooms, and flats, and communicate with property owners through inquiries. Stayza is not a landlord, broker, real estate agent, or a party to any rental agreement between users.

Stayza ("Stayza", "we", "us", or "our") is an online platform operated by the Stayza team, based in Pakistan. You can reach us at hello@stayza.pk.

To use Stayza, you must meet the following criteria:

• Be at least 16 years old; users under 18 may use Stayza only with the consent and involvement of a parent or legal guardian.
• Provide accurate, current, and complete information during registration.
• Keep your account secure and never share your login credentials with others.
• Use the platform only for lawful purposes and in line with these Terms.

When you create an account, you must provide information that is accurate, complete, and current at all times. Failure to do so is a breach of these Terms and may result in suspension or termination of your account.

You are responsible for all activity that happens under your account. Notify us immediately at hello@stayza.pk if you suspect any unauthorised use.

Stayza is a discovery and lead-generation platform. We help you find verified accommodation and connect with owners through inquiries — we do not own the listed properties, take bookings, or collect rent. As a student or seeker, you agree to:

• Independently verify the condition, pricing, and terms of any accommodation before paying a deposit or rent directly to an owner.
• Never send deposits or rent to unverified owners, and always perform your own due diligence before paying.
• Communicate honestly and respectfully with property owners.
• Leave reviews that are genuine and based on real experiences.

If you list a property on Stayza, you are responsible for the accuracy and legality of your listing. You agree to:

• Provide accurate, up-to-date information — pricing, amenities, availability, and photos must reflect reality.
• Complete identity verification (including CNIC) and pass a live video call with a Stayza reviewer before your listings are published.
• Respond to student inquiries in a reasonable and timely manner.
• Only list properties you are legally entitled to offer, and keep listings current.

Students appointed under the Stayza Campus Ambassador Program represent the platform's values on university campuses across Pakistan. Ambassadors agree to:

• Promote authentic, verified accommodations accurately without making misleading promises or unauthorized pricing guarantees.
• Never charge students or property owners any fee, commission, or kickback in connection with inquiries, referrals, or listings.
• Comply fully with their university's campus regulations, premises rules, and student conduct policies.
• Respect peer privacy and never collect, store, or distribute fellow students' identity numbers, contact details, or credentials without explicit written consent.

To enhance marketplace transparency and deter deceptive listings, Stayza applies a defined Verification Taxonomy. Each badge signifies only the specific administrative review performed:

• Host Identity Reviewed — The submitted identity document (CNIC/Passport) was reviewed under Stayza's internal procedure to associate the account with the individual operating it. This does not verify property ownership, agency authority, tenancy rights, or NADRA/governmental certification.
• Address Checked — The submitted address underwent Stayza's administrative mapping and geocoding consistency checks. This does not verify ownership, title, zoning, licensing, or physical safety, and is not a premise inspection.
• Video Verified — A Stayza reviewer held a live video call with the host, who showed the property on camera, cross-checked against the listing's photos and claimed amenities. This is mandatory before a listing is approved. Calls are not recorded, and this is materially weaker evidence than an in-person visit.
• Site Visit Verified — A physical on-site visit was conducted on a stated date to capture photographs and review basic visible amenities. This is optional and strictly stronger evidence than Video Verified, but is not an engineering, electrical, fire, structural, health, safety, licensing, or regulatory inspection.

These are the only verification badges Stayza issues. A verification badge describes the specific check performed at the recorded time and does not constitute a continuing representation that the host, property, address, amenities, or conditions remain unchanged.

The platform lets you post content such as listing details, text, photos, reviews, and ratings ("Content"). You are responsible for the Content you post, including its legality, accuracy, and appropriateness.

You retain ownership of your Content, and by posting it you grant Stayza a non-exclusive licence to host, display, and promote it as part of operating the Services.

Reviews and ratings must reflect genuine, firsthand experiences. We may remove reviews or other Content that is fake, abusive, defamatory, or violates our guidelines.

Stayza may use artificial intelligence to power features such as AI Search and to improve recommendations and ranking. To do this we process your search inputs and certain usage signals.

Paid plans for property owners are billed in Pakistani Rupees (PKR). The following terms apply:

• When plans start — a subscription begins once your payment is verified and the plan is activated.
• Billing cycle — plans are offered on monthly or annual cycles, as shown at checkout.
• Renewal & expiry — we do not auto-charge a saved card. Near expiry we notify you, and you renew by submitting payment again. If you don't renew, the plan expires and the listing reverts to the free tier.
• Upgrades & downgrades — you can change plans from your dashboard; downgrades take effect at the end of the current cycle.
• Cancellation — you may stop using a paid plan at any time; it remains active until the end of the paid period.
• Failed or unverified payments — if your proof of payment can't be verified, the plan won't activate and we'll contact you to resolve it.
• Taxes — prices exclude any applicable taxes unless stated; you are responsible for taxes that apply to you.

Invoices are available from your dashboard. Subscription fees are non-refundable except where stated otherwise in our Refund Policy.

To keep the marketplace safe and trustworthy, the following are not allowed and may result in immediate suspension or a permanent ban:

• Creating fake or multiple accounts, or posting duplicate listings.
• Posting inaccurate pricing, amenities, photos, or other misleading information.
• Writing fraudulent reviews — positive or negative.
• Posting illegal, infringing, or harmful content — including copyright infringement, malware, hate speech, pornographic content, or spam.
• Harassing, threatening, or discriminating against other users or staff.
• Using bots, scrapers, or automated tools without permission.
• Attempting to circumvent platform systems, security, or verification.

You own the Content you upload (such as listing details, photos, and reviews), subject to the licence you grant us to host and display it.

Stayza owns all rights to the platform itself — including the Stayza name, logo, branding, user interface, source code, AI systems, database structure, and verification badges. You may not copy, reuse, or reproduce these without our written permission.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. Your use of the Service is at your sole risk.

You agree to indemnify, defend, and hold harmless Stayza, its founder, officers, contractors, and campus ambassadors from any claims, damages, losses, consumer court complaints, or legal expenses (including reasonable attorney fees) arising from: (a) your use or misuse of the platform; (b) any listing, review, or content you submit; (c) your violation of these Terms; or (d) your off-platform agreements with other users.

Stayza is not liable for any failure or delay in providing the Services caused by events beyond our reasonable control, including internet or hosting failures, power outages, cyberattacks, government actions or restrictions, and natural disasters.

We may suspend or terminate your account at any time, with or without notice, if you breach these Terms or engage in conduct that harms the platform or its users — including fraud, abuse, or prohibited activities. Here's what happens on termination:

• Active subscriptions — paid plans may end without refund where termination results from your breach.
• Listings — listings tied to a terminated account are removed from public view.
• Reviews & messages — reviews may be retained or anonymised; messages are handled as described in our Privacy Policy.
• Data retention — certain records are retained after closure for the limited periods set out in our Privacy Policy.
• You may also close your account yourself at any time from your settings.

We may update these Terms from time to time as our platform and legal obligations evolve. The "Last updated" date above always reflects the most recent revision.

For material changes, we will notify registered users by email and/or an in-app notice before they take effect. Continued use of Stayza after changes means you accept the updated Terms.

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the substantive laws of Pakistan, specifically including the Prevention of Electronic Crimes Act 2016 (PECA), the Electronic Transactions Ordinance 2002 (ETO), and provincial consumer protection statutes (including the Punjab Consumer Protection Act 2005 and Islamabad Consumer Protection Act).

Pre-Action Dispute Notice: Before instituting any formal court proceeding or consumer tribunal action, you agree to notify Stayza at legal@stayza.pk and engage in good-faith informal mediation for at least thirty (30) business days.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect.

Waiver

Our failure to enforce any provision is not a waiver of our right to enforce it later.

Entire agreement

These Terms, together with our Privacy Policy, Refund Policy, and Cookie Policy, form the entire agreement between you and Stayza regarding the Services.
